Review of shared property management policy

The Department’s scoping study into the oversight of shared property management initiated at the start of the year by the then Minister Dr Caoimhe Archibald MLA is now complete. Its report is available below.
At present there is no legislation dealing specifically with shared property (e.g. the communal areas in apartment blocks) in this jurisdiction, and no regulation.
The review draws on the following sources:
- Previous work in this policy area including a 2010 Private Member’s Bill and a 2013 report on apartments by the Northern Ireland Law Commission (NILC).
- Policy in neighbouring jurisdictions.
- The views of a number of key stakeholders including MLAs, housing associations, Co-ownership, residential conveyancers and officials in other government departments.
It sets out a number of options for future policy in this area. The Finance Minister has now considered those options and has indicated that reform is desirable. Resources will be in place from the start of the 2026/27 financial year to undertake this work.
