  • What to expect if you are considering appealing a 2015 Remedy Ill-Health Retirement Re-assessment

    This guide is for members who wish to appeal the Scheme Medical Adviser’s 2015 Remedy re-assessment outcome.

    Important Note 

    The process for appealing the outcome of a 2015 Remedy medical Re-assessment is a one-stage appeal process, and the outcome decision of such an appeal is final.                                                            

    Eligible members

    • Are affected by the Remedy
    • Had an application for ill-health retirement between 1 April 2015 and 31 March 2022
    • Have recently received a letter from Civil Service Pensions (Northern Ireland) [CSP(NI)] or your employer/previous employer advising that your case has been re-assessed by the Scheme Medical Adviser (Occupational Health Service), to determine if you would have met the ill-health retirement criteria under your alternative scheme, in response to the 2015 Remedy (McCloud) judgment

    Step by step guide to making an appeal

    1.    Make your application to appeal

    • After reviewing your letter advising of your re-assessment outcome, if you wish to appeal you must complete the 2015 Remedy Re-assessment Appeal Application Form and return it to the address in the letter along with any additional previously unseen medical evidence within 3 months from the date on your re-assessment outcome notification letter
    • Note any additional evidence must be contemporaneous, meaning it must have existed at the time that you were originally assessed for ill-health retirement. To be clear this must be additional evidence previously unseen by the Scheme Medical Adviser and it must be signed by a recognised health care professional and dated on or before the date of your original assessment. No new more current medical evidence will be considered
    • Once received, your application to appeal along with any additional evidence received will be securely transferred to the Scheme Medical Adviser for their consideration.

    2. Scheme Medical Adviser reviews your appeal

    A different medical adviser to the one that made the original decision will:

    • Review your appeal application and any additional medical evidence submitted
    • Complete their assessment based on the available information
    • Issue the outcome of your appeal application directly to CSP(NI) or your  employer/previous employer within 28 days of receipt (some cases may be more complex and will take longer to process)

    3. When the appeal outcome is received from the Scheme Medical Adviser

    • CSP(NI) or your employer/previous employer will notify you in writing of the outcome of your appeal within 28 days of receipt of the Scheme Medical Adviser’s decision
    • The outcome of your appeal will be a final decision
